I’ve read many injured worker WCB files, including initial claim forms and claim logs. The biggest problem I see is that most people who get a WCB claim denied in BC simply don’t persuade WCB to accept their claim. Yes, you need to persuade WCB to accept your claim.
How do you persuade WCB in BC to do anything? With evidence and an explanation how the evidence supports your claim. I can’t overstate how important it is that you get your WCB claim accepted the first time around. You see, I work with people whose claims were denied by WCB. We win a lot of appeals, but let me tell you, it was not an easy road to winning the appeal for our clients.
WCB BC claim denials can be devestating
If you’re claim is accepted, it’s usually accepted within 17 days – at least that’s the timeline WorkSafeBC shoots for getting a claim accepted. If your claim is denied, and you happen to win on the first appeal, you’re looking at a potential delay of 6 to 12 months. If you don’t win on the first appeal, you may not receive compensation – including lost wages for up to 2 years.
Do you have bills to pay? A mortgage? People to support? Think about going without any money for up to two years. You can become destitute pretty quickly. You also don’t get the treatment you need when a claim is denied.
